Could Google successfully challenge the EU Commission’s antitrust fine?

Google is considering whether to appeal the antitrust fine the European Commission issued last month. Although the Commission has not lost a monopoly case before the EU courts in 38 years, Politico estimates that Google might be able to put forward a strong enough case for the decision to be overturned.

Amazon would be likely to be included in the company’s arguments, as Google could claim that Google Shopping is a counter-balance to Amazon’s dominance, rather than hampering competition. Google would also be likely to argue that the Commission’s case is different from textbook antitrust cases, and the standard of proof might be questioned.
